Agreement: By booking with Trekup India, you confirm that you have read, understood and accept these terms and conditions, including the trip details and notes shown on the trek page and our Cancellation Policy. These terms apply to all services provided by Trekup India and may be updated from time to time.

1. Agreement and booking

1.1 A binding agreement between you and Trekup India is formed when payment (the advance or the full amount) has been received and Trekup India has issued a Confirmation Invoice.

1.2 The person making the booking, whether for themselves or for others, accepts these terms on behalf of every participant in the booking and is responsible for paying the full amount.

1.3 We recommend booking at least two months in advance to secure your spot and allow smooth coordination.

1.4 By booking, the person booking confirms that they are 18 years or older, that they accept these terms for themselves and all participants, and that this is a binding legal contract. Participants under 18 are covered by section 23.3.

1.5 This agreement is governed by the Indian Contract Act, 1872, the Information Technology Act, 2000 and the Consumer Protection Act, 2019. Electronic acceptance of these terms forms a legally binding contract.

2. Itinerary and changes

2.1 Each itinerary is planned by our team of experienced mountain professionals. It may change at short notice because of weather, natural calamities, landslides, vehicle breakdowns, local curfews, strikes or other events beyond our control. Any additional expense caused by such a change is borne by the customer.

2.2 Driving distances and travel times in the itinerary are approximate and may vary with road conditions and stops.

2.3 We strongly recommend keeping at least one buffer day before your return journey, because delays in the mountains are common.

2.4 Foreign nationals pay forest permit fees in addition to the trek fee, depending on the trek.

3. Pricing

3.1 Prices on our website and documents are based on current rates and the current Indian tax structure. Trekup India may revise prices at any time without notice, unless your booking is confirmed with an advance payment. A price quoted at the time of inquiry is valid only for a limited time.

3.2 Any increase in taxes, government or local fees, transport costs, union charges, fuel surcharges, third-party accommodation rates, or local rates for mules, porters and local guides is borne by the customer. In the Himalayas these local rates can rise at short notice.

3.3 All prices assume a minimum group of six (6) participants. If the minimum is not met, Trekup India may merge your group with another trek or cancel the trek after consulting the participants.

4. Offers and discounts

4.1 Promo codes and special offers must be applied at the time of booking. They cannot be applied later, including as a refund or post-purchase adjustment.

4.2 Promotional discounts apply only to the base cost of the trek, not to rental gear, offloading or other add-ons.

4.3 Discount policy: 10 or more people in a group pay for 9 (the discount excludes 5% GST); children aged 9 to 14 receive a discount; the fourth trek with Trekup India receives 10% off. Discounts cannot be combined or transferred, apply only to fixed departures in India booked directly with Trekup India, and do not apply to treks above 5,000 metres, peaks, passes or weekend treks. Original documents must be shared when booking, and Trekup India confirms every discount by email.

5. Payment

5.1 30% of the invoice amount is paid at booking to secure your seat, and the remaining 70% is paid at least 7 days before the trek start date.

5.2 A booking without timely payment stays unconfirmed and depends on seat availability. Trekup India may cancel it without notice, give the slot to another customer, and is not liable for any refund.

5.3 Payments are processed securely through Razorpay by Google Pay, PhonePe, UPI, Paytm, PayPal, credit card or debit card. EMI is available on selected methods.

6. Cancellation

6.1 This section follows our Cancellation Policy. If the two ever differ, the Cancellation Policy page applies. To cancel, follow the process in the Cancellation Policy. Cancellation charges apply from the date Trekup India receives your written notice. Verbal or informal requests are not valid.

6.2 The deduction depends on the number of days between your notice and the trek start date:

6.3 If a trek is cancelled before it starts because of weather, government orders or other circumstances beyond our control, the same schedule applies, based on the days remaining before the trek start date. If the trek has already started and you cannot complete it, the Free Trek section of the Cancellation Policy applies.

6.4 If you do not report on the trek start date without prior communication, 100% is deducted and no voucher is issued.

7. Trek Vouchers

7.1 A Trek Voucher is issued for a cancellation as per section 6 and the Cancellation Policy. It is valid for 12 months from the date of issue.

7.2 It can be used for any Trekup India trek, tour or yatra.

7.3 To redeem it, follow the process in the Cancellation Policy, at least 15 to 20 days before the trip. Last-minute requests depend on seat availability.

7.4 It must be redeemed for the same number of persons it was issued for.

7.5 It can be gifted to a family member if you cannot attend.

7.6 It can only settle an amount due on an existing booking. It cannot be used to create a new booking.

7.7 It cannot be reissued, changed or extended beyond its expiry date.

7.8 Once a voucher is redeemed, the amount cannot be reissued if that booking is later cancelled.

8. Cash refunds

8.1 No cash refund is given when you cancel, or when a trek is cancelled because of weather, natural disasters, government restrictions or other external factors. If the trek is cancelled before it starts, section 6 applies and the refund is a Trek Voucher. If the trek has already started and you cannot complete it for one of these reasons, you may be eligible for a Free Trek under the Free Trek section of our Cancellation Policy.

8.2 A cash refund is given only when Trekup India cancels a trek without justification, or when the required group size is not achieved and the trek is cancelled.

8.3 Cash refunds are processed within 12 to 14 working days from the scheduled trek date, or in line with Trekup India's accounts processing cycle.

9. Date change

9.1 Send date change requests by email to info@trekupindia.com at least 7 days before the original trek start date.

9.2 The first date change is free. From the second change onward, a fee of 10% of the invoice amount applies per change.

9.3 Once a date change is processed, the booking becomes non-cancellable and non-refundable under any circumstances.

10. Unused services

10.1 Accommodation, meals, transport, sightseeing and any other inclusion that you do not use are non-refundable and non-exchangeable, whatever the reason.

11. Accommodation, equipment and toilets

11.1 Accommodation is usually multi-sharing in hotels and guest houses and double-sharing in tents. It is basic, clean and well maintained, except in Sankari, where Trekup India owns a deluxe property. Single or double occupancy in a guest house or hotel may cost extra. Carry your own toiletries.

11.2 Trekup India provides dining, kitchen, toilet and sleeping tents, mattresses and sleeping bags. All equipment is checked before the trek. Tell your Trek Leader at once if there is a problem, and our team will fix it.

11.3 Toilets on the trek are dry: a hole is dug, you clean with dry toilet paper and cover with the mud provided. Do not use wet wipes or water.

12. Transport, pickup and drop-off

12.1 Trekup India may use subcontracted drivers and vehicles (Bolero, Tempo Traveller or bus, depending on group size) when its own transport is not available. Clients may not drive any vehicle during the trek.

12.2 You are responsible for your own luggage and belongings. Check them when boarding and leaving vehicles.

12.3 Pickups are usually early morning, between 05:00 and 06:30, at a central point near the railway or bus station. A 30-minute buffer may be given. If you miss the pickup, you reach the base camp at your own cost.

12.4 Drop-off is at the pickup point, usually between 18:00 and 19:00. Plan onward travel for late evening or the next day.

13. Trek Leaders and guides

13.1 Our Trek Leaders hold national mountaineering certifications (Basic and Advanced) and are trained in first aid and search and rescue. The Trek Leader's decision on safety is final.

14. Insurance

14.1 Trekup India does not provide or charge for travel, adventure or medical insurance. We strongly recommend that every trekker buy insurance before the trek.

14.2 We can only help you contact an insurance provider. You pay the premium, the provider's terms apply, and you deal directly with the provider on any claim.

15. Health and conduct

15.1 You must tell Trekup India in writing at booking about any medical condition, physical challenge or mental health concern that may affect your fitness. If you do not, you may be refused participation and 100% cancellation charges apply.

15.2 Smoking and alcohol are strictly forbidden on the trek. A participant who breaks this rule is removed from the trip without notice or refund.

16. Force majeure and liability

16.1 Trekup India is not responsible for the consequences of natural disasters, adverse weather, flight delays or cancellations, quarantine restrictions, strikes, theft, civil disorder, government regulations or other force majeure events. It is also not responsible for accidents, breakdowns or delays involving any vehicle in the program, or for damage or loss of your personal belongings.

16.2 Trekup India will try to inform you promptly and may modify or cancel any trip as needed. Additional costs caused by such changes are borne by the guest.

16.3 In a natural calamity or emergency, Trekup India or its partners on the ground manage safety and urgent needs, possibly without consulting you first. The cost of emergency action is borne by the customer.

16.4 You are responsible for looking after your own belongings at all times, including in vehicles, hotels, camps and on the trail. You are responsible for any loss, theft or damage to them, and Trekup India is not liable for it.

16.5 Guides, porters, mule handlers, drivers and some accommodation are provided by independent third parties. Trekup India selects them with reasonable care, and to the extent permitted by law is not liable for their independent acts, failures or delays.

17. Waiver and disclaimers

17.1 Trekking involves risk. Every participant signs a Waiver of Responsibility Disclaimer Form before the trek and must use personal judgment and care at all times.

17.2 Trekup India takes reasonable care that the information on its website and in its communications is accurate, but is not responsible for unintentional errors or outdated information. If there is a conflict, these terms and conditions prevail over earlier statements.

18. Complaints and jurisdiction

18.1 Tell your Trek Leader or our Operations Manager, Mr. Nanda Rawat (info@trekupindia.com), about any problem as soon as it happens, so we can fix it on the spot. Trekup India is not responsible for dissatisfaction about a problem it was not told about at the time.

18.2 If a concern is not resolved during the trek, send a formal written complaint within 7 days of returning home.

18.3 These terms are governed by Indian law, and the courts of Dehradun, Uttarakhand have jurisdiction.

19. Data protection

19.1 Personal information you give us, such as dietary needs, medical history or disabilities, is kept confidential. It is shared only with the relevant authorities or team members when needed to deliver the services or meet legal requirements. You may ask to review your data during normal working hours.

20. Rental gear

20.1 Available on rent: trek shoes, trek poles, poncho, double padded jacket, head torch, water bottle, trek pants and gloves (take-away, non-returnable).

20.2 Gear is first come, first served. Book online in advance and pay the full rental amount at booking. Booking at base camp depends on availability and costs 30% more. Show your valid booking ID at base camp.

20.3 Check the gear when it is issued and report any problem at once. Use it only for trekking, and do not share, resell or lend it. Gear is provided as is.

20.4 Return it at the base camp in the condition issued, apart from normal wear. Late returns may cost an extra amount per day.

20.5 Damage and loss: minor wear at a nominal repair cost, significant damage at the actual repair or replacement cost, and loss or non-return at the full replacement value.

20.6 Trekup India takes no monetary deposit. You may be asked to leave an original ID card, which is returned with the gear.

20.7 Rental gear that you booked is non-refundable if you do not use it or if you cancel. If Trekup India cancels the trek, the rental amount is refunded as a credit voucher valid for 12 months. Size exchange at base camp depends on availability.

20.8 Trekup India may refuse rental to a trekker who has misused gear or not returned it.

21. Backpack offloading

21.1 Book offloading in advance at registration or after speaking with your Trek Coordinator. Requests at base camp depend on availability and cost 30% more. Booking directly with mule handlers or Trek Leaders during the trek is not allowed, and Trekup India is not responsible for any loss or damage to bags booked that way.

21.2 On some treks a minimum number of offloading bookings is needed. If it is not met, the service may be cancelled and the amount refunded.

21.3 Only trekking backpacks with rain covers are accepted. Bags must be locked and labelled with your name, booking ID and phone number. Do not pack valuables, alcohol, cigarettes, flammable or sharp items, fragile electronics or illegal substances. A violation means the bag is confiscated and the service cancelled without refund.

21.4 The maximum weight is 10 kg. Heavier bags may be refused or charged double.

21.5 Bags travel camp to camp and are not available on the trail during the day, so carry a daypack with water, snacks, medicines and a camera. Bags may be delayed by weather or trail blockages, and minor wear and tear can occur.

21.6 Offloading charges are non-refundable if you decide not to use the service. They are refunded in full if Trekup India cannot provide the service for operational or safety reasons. If the trek is cancelled before departure, they are refunded as per section 6.

22. Blacklisting

22.1 Trekup India may permanently blacklist a trekker for any of the following: abuse, threats, harassment or assault; ignoring the Trek Leader's safety instructions, trekking under the influence or tampering with safety equipment; non-payment of dues, fraudulent chargebacks or false refund claims; littering, damaging the trail or disrespecting local communities; spreading false or defamatory information about Trekup India; theft or misuse of its equipment; concealing medical conditions or refusing medical checks; and misuse of drones, cameras or private information.

22.2 Consequences include cancellation of current and future bookings without refund, no future participation, reporting to the authorities where the law is broken, and notification to partner organisations if required. Trekup India's decision is final, and legal action may follow.

23. Risk acknowledgement and voluntary participation

23.1 You understand that trekking in the Himalayas involves risks, including altitude sickness, extreme weather, rough terrain, injury, illness, landslides and, in rare cases, death. You take part voluntarily and accept these risks.

23.2 Trekup India will take reasonable care and use trained, certified staff. Nothing in these terms limits any liability that cannot be limited under Indian law.

23.3 If a participant is under 18, a parent or guardian must make the booking or sign a consent, and accepts these terms on the minor's behalf.

23.4 To the extent permitted by law, Trekup India's total liability to you for any claim about a booking is limited to the amount you paid for that booking, and Trekup India is not liable for indirect or consequential losses. This does not apply to liability that cannot be limited under Indian law.

23.5 You agree to indemnify Trekup India against claims, damages, losses and legal costs caused by your own breach of these terms, your misconduct, your unsafe behaviour or false information that you gave.

24. Fair charges

24.1 You agree that the cancellation deductions in section 6 are a reasonable estimate of the loss and cost Trekup India bears (permits, staff, supplies and arrangements fixed in advance). They were shown to you before you paid.

25. Electronic acceptance and records

25.1 Accepting these terms by tick box, by payment or by completing a booking is a valid electronic acceptance under the Information Technology Act, 2000.

25.2 Trekup India's records of your booking, payment, acceptance (including date and time) and emails are accepted as evidence of this agreement.

25.3 Notices to you are sent to the email address and phone number given at booking. Notices about cancellations and vouchers are sent as set out in the Cancellation Policy. Other notices to Trekup India are sent to info@trekupindia.com.

26. Dispute resolution

26.1 If you have a dispute, first send a written complaint as described in section 18. Both sides will try in good faith to settle it by discussion.

26.2 If it is not settled, it is subject to the jurisdiction of the courts in Dehradun, Uttarakhand, as stated in section 18.

26.3 This section does not take away any right you have under the Consumer Protection Act, 2019.

27. General

27.1 These terms, the Cancellation Policy, the trek details on the website, your Confirmation Invoice and the signed waiver form together form the whole agreement between you and Trekup India.

27.2 If any part of these terms is held invalid or unenforceable, the rest stays in force.

27.3 Trekup India may update these terms. The version in force on the date of your booking applies to that booking.

27.4 If Trekup India does not enforce a term at any time, it does not give up its right to enforce it later.

28. Privacy consent

28.1 You consent to Trekup India collecting and using your personal and medical information to run your booking, keep you safe, handle emergencies and meet legal requirements. It may share this information with trek staff, partners, insurers and authorities only when needed for those purposes.

28.2 You may ask to correct or delete your information by writing to info@trekupindia.com, subject to legal and safety record-keeping needs.

28.3 You allow Trekup India to use photos and videos taken during the trek for marketing. If you do not want your image used, tell us in writing before the trek starts.

29. Acceptance

By booking with Trekup India, you accept these terms and conditions and our Cancellation Policy for yourself and for every person included in your booking.
